Welcome to EvidX. Before using the application, please read these Terms and Conditions of Use ("Terms") carefully. These Terms constitute a legally binding agreement between you (the "User") and Dr. Julián Treviño González, who operates EvidX as a natural person with business activity (RFC TEGJ900425FC5, domiciled in Tepic, Nayarit, Mexico) ("EvidX", "we", "our"), a project co-founded with Ing. Armando Olivares Olivares, with the "EvidX" trademark registered before the Mexican Institute of Industrial Property (IMPI). Should EvidX later be incorporated as a commercial company, the rights and obligations under these Terms will be deemed assigned to that company, which will be notified to the User pursuant to Section 20.
By downloading, registering, or using the EvidX application ("the Service"), you declare that you have read, understood, and fully accepted these Terms and the Privacy Policy. If you disagree with any provision, you must refrain from using the Service.
EvidX is a knowledge acceleration tool for the personal study of published scientific literature. EvidX applies to the text of the article —not to the patient. EvidX is not a medical device, is not clinical decision support (CDS) software, is not Software as a Medical Device (SaMD), does not generate diagnoses, does not recommend treatments, does not score patient images or signals, and is not designed, marketed, or intended to directly or exclusively influence clinical decisions about specific patients.
EvidX IS A KNOWLEDGE ACCELERATION, STUDY, AND SCIENTIFIC-LITERATURE TRIAGE TOOL. IT IS NOT A DIAGNOSTIC OR CLINICAL-DECISION TOOL.
The sole and exclusive purpose of EvidX is to help the healthcare professional decide which scientific articles merit a full read, generating summaries and structuring information from published scientific literature to facilitate personal critical analysis for academic and continuing-education purposes.
Expressly and to avoid any ambiguity, the User acknowledges and accepts that:
Internal product and data-schema denominations that include the word "clinical" have a descriptive sense of the subject-matter domain (clinical medicine as a branch of knowledge) and do not imply that the output constitutes clinical advice, management recommendations, or a medical opinion applicable to any patient.
EvidX is not a medical device or Software as a Medical Device (SaMD). EvidX has not been evaluated or approved by Mexico's Federal Commission for the Protection against Sanitary Risks (COFEPRIS), the U.S. Food and Drug Administration (FDA), the European Union CE marking, or any other health regulatory authority.
By its nature as an exclusive tool for academic study, summary generation, and triage of published scientific literature, EvidX falls outside the scope of health regulation applicable to medical devices and clinical software. The User expressly acknowledges this nature and undertakes to use the Service solely for educational, academic, and continuing-education purposes.
Health notice (App Store / Google Play). EvidX is not a medical device and is not intended to diagnose, treat, cure, prevent, or mitigate any disease or medical condition. EvidX does not provide medical advice. Information generated by EvidX is for educational and scientific-literature study purposes only and does not replace the advice, diagnosis, or treatment of a healthcare professional. Always consult a qualified healthcare professional with any question about a medical condition or before making any clinical decision.
EvidX is a mobile application for Spanish-speaking healthcare professionals that transforms published scientific articles into structured summaries and triage reports using artificial intelligence. The report is organized into five tabs generated through several processing stages.
EvidX is designed for medical residents, junior specialists, general practitioners, interns, and medical students in Latin America, with the exclusive purpose of supporting personal study and triage of scientific literature.
To use the Service, the User represents and warrants that: they are over 18; they are a practicing healthcare professional, medical student, resident, intern, or biomedical researcher; they have legal capacity to enter binding agreements in their jurisdiction; they will use the Service exclusively for academic study, continuing education, and personal triage of scientific literature; and they will comply with all laws, professional regulations, and ethical codes applicable to their practice.
EvidX is directed exclusively at healthcare professionals and students. It is not directed at patients seeking medical information about specific conditions.
EvidX reserves the right to modify, suspend, or discontinue any feature. Modifications materially affecting a subscribed User's rights will be notified with reasonable advance notice.
The User must create an account providing truthful, accurate, and current information. They are responsible for keeping their credentials confidential and for all activity under their account, and must notify EvidX immediately of any unauthorized use or detected security breach. Accounts are personal and non-transferable; sharing credentials with third parties, including colleagues or residents in the same program, is prohibited and constitutes grounds for immediate termination without refund.
Payments are processed through the Apple App Store and Google Play Store in-app purchase systems, technically managed by RevenueCat Inc. EvidX does not store or directly process the User's financial information.
Auto-renewal. Subscriptions are auto-renewable at the USD price in effect at the time of purchase, clearly indicated before confirming. Unless cancelled, the subscription renews automatically at the end of each period for an equivalent period. The User may cancel renewal at any time at least 24 hours before the end of the current period, from their App Store (iOS) or Google Play (Android) account settings, retaining access until the end of the already-paid period.
Refunds. Refunds are subject to Apple App Store and Google Play policies. EvidX does not process refunds directly.
Price changes. EvidX may modify prices with at least 30 calendar days' notice. Continued use after the new price takes effect constitutes acceptance.
Digital goods — immediate performance. The User acknowledges that the Service is immediate-performance digital content. Beginning use after purchase implies express acceptance of immediate performance and the inability to exercise a right of withdrawal over already-consumed periods, without affecting the right to request refunds from Apple or Google under their policies.
Each plan includes a maximum number of monthly analyses and podcasts. Unused analyses and podcasts do not roll over to the next month. EvidX may implement technical measures to prevent abuse, including rate limiting, suspension of accounts with anomalous or automated use, and termination of accounts that attempt to circumvent contracted limits.
Long documents. A normal analysis consumes 1 analysis from your quota. Very long documents —clinical guidelines, consensus statements and similar, typically over 100 pages— require considerably more processing and consume 3 analyses from the User's monthly quota.
EvidX never deducts those 3 analyses without your authorization. Before processing a long document, the app tells you the page count, the cost in analyses, and your remaining balance, and processing starts only if you expressly confirm. If you cancel, nothing is deducted.
On first use, the User receives an explicit notice about AI limitations. By continuing to use the Service, the User acknowledges that EvidX Analyses are generated by Large Language Models which, by their probabilistic nature, may: (i) hallucinate, producing factually incorrect statements that appear truthful; (ii) fabricate citations, references, authors, numerical data, confidence intervals, p-values, sample sizes, and statistical results that do not appear in the original article or do not exist; (iii) confuse or swap information between studies; (iv) omit relevant information present in the article; (v) apply incorrect interpretive frameworks to the study's methodological design; and (vi) produce inaccurate translations into Spanish.
EvidX does not equal peer review, expert human critical reading, or a second medical opinion. EvidX Analyses do not constitute the medical, academic, or professional opinion of any person. The User assumes the professional duty to verify any relevant data against the original article before using, sharing, or citing it. EvidX does not guarantee that analyses are complete, accurate, error-free, or up to date.
Before the first analysis, EvidX explicitly informs you that the text of the article you upload is transmitted to a third-party artificial-intelligence provider (Anthropic PBC, in the United States) for processing, and requests your affirmative consent. Details of this transfer are in the Privacy Policy. Podcasts are audio generated from the Analyses and share the same accuracy limitations.
Educational and study nature. All content generated by EvidX —including structured analyses, summaries, podcasts, PDF exports, and any output— is provided exclusively for study, continuing education, and personal triage of scientific literature. It does NOT constitute medical advice, does NOT equal a professional opinion, and does NOT replace the treating physician's clinical judgment.
No physician-patient relationship. Use of the Service does not establish a physician-patient relationship between EvidX and the User, nor between EvidX and any patient of the User.
Absolute responsibility of the treating physician. Every clinical decision regarding specific patients is the exclusive responsibility of the treating physician. Any application of information obtained from the Service in professional practice must pass through the User's own clinical judgment, validation against primary sources, and compliance with applicable institutional protocols.
Mandatory footer. Each PDF-exported report includes the footer: "This report does not replace professional clinical judgment." This legend may not be removed or altered by the User.
Express waiver for patient harm. The User acknowledges that any harm, injury, deterioration, or adverse consequence suffered by a patient as a result of a clinical decision the User made, in whole or in part, based on information from an EvidX Analysis or podcast, constitutes use of the Service contrary to the purpose declared in these Terms and falls outside any liability attributable to EvidX, its owner, founders, shareholders, and employees. The User exclusively assumes that responsibility and releases EvidX from any related claim.
The User undertakes NOT to use the Service to: upload content that infringes third-party intellectual-property rights; upload files containing patient-identifiable personal information, protected health information (PHI/PII), or any sensitive individual health data; make individual clinical decisions about specific patients based solely on the generated analyses; reverse-engineer, decompile, or attempt to access the source code, underlying AI models, system prompts, or architecture; use automated techniques, scraping, or bots to extract data in volume; resell, sublicense, rent, or commercially distribute the EvidX Analyses or podcasts without express written authorization; or use the Service for unlawful, fraudulent, or professionally unethical purposes.
Upload restriction: published scientific literature only. The User is only authorized to upload published scientific articles (clinical trials, meta-analyses, clinical guidelines, systematic reviews, observational studies, and the like). It is ABSOLUTELY PROHIBITED to upload any file containing patient data, medical records, clinical notes, diagnostic images with identifiable data, or any personal health information.
The User retains ownership of the PDF files they upload and represents and warrants that the file is a published scientific article over which they hold the necessary rights, licenses, or applicable legal exceptions; that it does NOT contain patient-identifiable personal information or protected health information; and that its processing by automated text-analysis tools is permitted by the source it comes from. The User is solely responsible for the content they upload and undertakes to indemnify EvidX against any related claim.
By uploading content, the User grants EvidX a limited, non-exclusive, royalty-free, worldwide license lasting as long as the technical processing needed to generate the corresponding EvidX Analysis, solely for the purpose of providing the Service. This license does not include redistributing the original content or training AI models with it. Uploaded PDFs are processed transiently and are NOT stored permanently on EvidX servers; only the generated EvidX Analysis is retained linked to the User's account.
All elements of the Service —including software, source code, design, the "EvidX" trademark registered with IMPI, the "Evidence, Decoded" claim, logos, interface, technical architecture, system prompts, analysis methodologies, and generated podcasts— are the exclusive property of EvidX and protected by applicable intellectual-property laws.
EvidX Analyses and generated podcasts are the property of EvidX. The User receives, for each Analysis, a non-exclusive, non-transferable, revocable, worldwide license for personal study and continuing-education use during the term of their subscription. The User may use the Analyses for personal study, share brief excerpts with colleagues in non-commercial academic contexts citing "EvidX" as the source, and use them in non-commercial internal academic sessions (journal clubs). The User may not resell, sublicense, or commercially distribute the Analyses; republish them on paid educational platforms or commercial courses without a license; remove credits or the "Evidence, Decoded" claim; or use the Analyses to train AI models.
EvidX operates under a transformative-use model: it receives a published scientific article, processes it algorithmically, and generates a new and distinct work consisting of a structured summary and triage analysis in Spanish, with original elements intended exclusively for the User's personal study. The Service does NOT reproduce, redistribute, or store permanent copies of the original uploaded content, and does NOT replace reading the original paper. This model relies on the transformative-use doctrine and copyright exceptions applicable to academic use, the right of citation, and transient technical processing, under Mexico's Federal Copyright Law (articles 148 and 151) and equivalent legislation.
Notice & Takedown. Any rights holder who believes the Service infringes their rights may notify [email protected], identifying the holder, the claimed content (DOI, PMID, title, authors, publisher), the element to be removed within the Service, and a statement under penalty of perjury. EvidX will acknowledge receipt within five (5) business days and may disable the relevant Analysis, suspend processing of the identified article, and/or notify the affected User, who may file a counter-notice. Adopting this procedure does not constitute an admission of liability or a waiver of the transformative-use position.
EvidX may suspend or terminate the User's account, with or without prior notice, for breach of these Terms, fraudulent or unlawful use, uploading files with patient-identifiable personal information, non-payment, or request of a competent authority. The User may terminate their relationship by cancelling their subscription and requesting account deletion; amounts paid are non-refundable except as provided in Section 9. After termination, EvidX will retain the account and analysis history for 90 calendar days, after which it may delete them permanently.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by applicable law, EvidX, its owner, shareholders, founders, officers, employees, agents, and business partners shall not be liable for indirect, incidental, consequential, special, or punitive damages; lost profits or data loss; clinical decisions made by the User or third parties based on the EvidX Analyses or podcasts, given that the Service is strictly a study tool and NOT a clinical-decision tool; patient harm arising from misuse of the Service in violation of its declared purpose; or interruptions or technical failures of the Service or of AI/infrastructure providers.
EvidX's total aggregate liability to the User for any cause shall in no case exceed the total amount actually paid by the User for subscription during the 12 months preceding the event giving rise to the claim. For free-plan Users, this maximum liability is limited to USD $50.00. Nothing in this Section excludes or limits liability that cannot be excluded or limited under applicable mandatory law.
The User undertakes to indemnify, defend, and hold harmless EvidX, its owner, founders, partners, shareholders, officers, employees, and agents, against any claim, demand, penalty, damage, expense, or legal fees arising from use of the Service outside the declared purpose of study and triage; breach of these Terms; infringement of third-party rights (including intellectual property, privacy, and medical confidentiality); uploading files with patient-identifiable personal information; and clinical decisions made by the User or any patient harm arising from misuse of the Service.
EvidX reserves the right to modify these Terms at any time. Modifications will be notified by publishing the updated version with its new "Last updated" date and, for material changes, by notice to the registered email or a visible in-app notice, at least 15 calendar days in advance. Continued use after the modifications take effect constitutes acceptance.
These Terms are governed by the laws of the United Mexican States. For their interpretation and enforcement, the parties submit to the competent courts of Guadalajara, Jalisco, Mexico, waiving any other jurisdiction. For Users residing outside Mexico, EvidX may submit to the jurisdiction of the User's country of residence only where required by mandatory local consumer-protection law.
These Terms, together with the Privacy Policy, constitute the entire agreement between the User and EvidX. If any provision is held invalid, the rest remain in full effect. Failure to exercise any right is not a waiver. The User may not assign these Terms without EvidX's prior written consent; EvidX may freely assign them as part of an incorporation, merger, acquisition, or corporate reorganization. These Terms are drafted in Spanish; any translation is provided for convenience and, in case of conflict, the Spanish version prevails.
This Section applies when you obtain or use EvidX through the Apple App Store or Google Play. In case of any conflict between this Section and the rest of these Terms with respect to such use, this Section governs solely for that purpose. These Terms are the End User License Agreement (EULA) governing your license to use the EvidX application.
(a) Acknowledgement. These Terms are concluded between you and EvidX (the developer) only, and not with Apple Inc. or Google LLC. EvidX, and not Apple or Google, is solely responsible for the Service and its content. These Terms do not provide usage rules for the Service that conflict with the Apple Media Services Terms and Conditions or the Google Play Terms of Service; in case of conflict, those store terms prevail.
(b) Scope of license. The license granted to you for the Service is a limited, non-transferable license to use the Service on any Apple-branded or Android device that you own or control, as permitted by the Usage Rules set forth in the applicable store terms, except that the Service may be accessed and used by other accounts associated with you via family sharing or volume purchasing where applicable.
(c) Maintenance and support. EvidX is solely responsible for providing any maintenance and support services for the Service, as specified in these Terms or as required by applicable law. Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the Service.
(d) Warranty. EvidX is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be EvidX's sole responsibility.
(e) Product claims. EvidX, and not Apple or Google, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
(f) Intellectual property rights. In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, EvidX, and not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
(g) Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
(h) Third-party terms. You must comply with applicable third-party terms of agreement when using the Service.
(i) Third-party beneficiary. You acknowledge and agree that Apple, Google, and their respective subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
